Recently, the Department of Justice sent out a memo reminding all US courts of the American people’s basic constitutional rights. The DOJ reminded the courts that raising revenue from poor defendants and imprisoning them w/o proper counsel in civil and criminal cases is illegal. Poor defendants are routinely deprived of the attorney that is guaranteed to them by their 6th and 14th amendment rights. The refusal to fund public defense has resulted in the unlawful imprisonment of millions of Americans unable to afford lawyers.
